With respect to personal information obtained in relation to using the service (hereinafter referred to as “the Service”) operated by Tounoki Ltd. (hereinafter referred to as “Company”), the Company provides our privacy policy as set forth below (hereinafter referred to as “This Policy”), makes an effort to pay close attention to protect such personal information of the users (hereinafter referred to as “the Users”) and handles it appropriately. For the purpose of This Policy, “Personal information” shall mean the personal information as defined by following definition.

“Special care-required personal information” shall mean the personal information as defined in Article 2 Paragraph 3 of the Act on the Protection of Personal Information.
“Personal Data” shall mean the personal information as defined in Article 2 Paragraph 6 of the Act on the Protection of Personal Information.
“Retained Personal Data” shall mean the personal information as defined in Article 2 Paragraph 7 of the Act on the Protection of Personal Information.
Company’s handling of the Personal Information
The Company shall comply with This Policy (The Act on the Protection of Persona Information) with respect to handling of personal information. The Company shall comply with other related laws, ordinances, national guidelines, and other norms for handling of personal information.
Obtaining of Personal Information
The Company clearly defines the purpose of utilization of the personal information, and within the extent necessary to achieve the purpose, it obtains accurate personal information by fair and appropriate means. Also, except in cases permitted by laws, when the Company obtains special care-required personal information, it obtains the person’s consent in advance.
Purpose of Utilization of Personal information
The Company may utilize personal information for the purposes as follows. In cases when the Company uses personal information for purposes other than the following, it informs purpose of the use individually.
- To identify the persons;
- To provide the Service, operate, process purchase and to conduct administrative processing related to the Service
- To respond customer inquiries
- To manage order history
- To conduct questionnaire survey and make statistics data
- To provide catalogues, direct mails, samples, products, and service, and deliver advertisements by the Company or by a company which has been determined by the Company to be appropriate
- To provide after-sales service and such
- To manage credit control, repair control, and conduct receivables management related to the trade transactions
- To charge for the fees and other service fee
- To proceed the procedures of the tax Affairs Division and other procedures required by law
- To respond to violations of laws and breach of these Terms
- To deal with disputes, claims and such relate to the Service
Use of Personal information
Except as permitted by laws, the Company handles personal information within the scope necessary for fulfillment of the purpose of use. Furthermore, the Company will take measures to prevent non-purpose use.
Provision to A Third Party
Except for the cases where the disclosure of personal information is allowed under the Personal Information Protection Act or other laws and ordinances, the Company shall not provide personal information to any third party without obtaining the Users’ prior consent.
Remedial Actions
The Company will take necessary measures to prevent the leakage, loss, and damage of personal information collected.
Disclaimer related to Provision to A Third Party
Regarding the obtainment of personal information by a third party that is not due to the reason for which the Company should not be blamed such as the cases when it is due to the conduct of the Users or to a cause that the Users should be blamed, the Company shall not bear any responsibilities for the acquisition of personal information.
Obtainment of additional information about the User
For the purpose of smooth operation of our business, the Company may obtain additional information about the Users’ use of the Service from the company that provided the personal information of the Users without the Users’ additional individual consent.
Matters related to security control measures
The Company will maintain a security system, implement management systems and take all necessary measures to educate staff and implement safety measures with the strict management of personal data in order to keep the personal information of our clients accurate and up to date, and to prevent the unauthorized access, loss, damage, alteration, or disclosure of personal data. The Company shall also provide necessary and appropriate supervision to employees and contractors who handle personal information.
Subcontract
In the event that the Company, to the extent required by the purpose of use, may consign the Users’ personal data to external third parties for processing, the Company shall provide necessary and appropriate supervision to the contractors.
Use of statistical information and such
The Company may use the Users’ personal information that it has collected to create statistical data that has been processed so that individuals cannot be identified. Statistical data that cannot identify an individual is not treated as personal information. Therefore, the Company may use, disclose or provide it without any restrictions. The copyright of the statistics and other information produced shall be the property of the Company.
Notification, disclosure, correction of the purpose of utilization, and request for suspension of use of retained personal data
In the event that the individual requests the following items with respect to the retained personal data, after confirming that the claim is from the Users or agent, the Company shall respond in accordance with the laws. A fee may be charged for such requests.
(1) Notification of the purpose of use regarding retained personal data
(2) Disclosure of retained personal data
(3) Correction, addition, or elimination of retained personal data
(4) Suspension of use, erasure of suspension of provision of retained persona data to third parties
Obtainment and use of attribute information and behavioral history that does not identify individuals
To create statistical data for the purpose of improving the Users’ convenience, when Users make use of the Service, the Company may automatically obtain the Users’ IP address, cookie information, pages viewed by the Users, other access logs and information about the Users’ environment of use.
Continuous Improvement in the Protection of Personal Information
The Company continuously review this Policy and strives to improve it. The Company may make changes without prior notice to the Users.
